Description
The GC will provide expert legal guidance and support ensuring compliance with all relevant laws and regulations for Boon-Chapman and its sister companies. The GC will manage a legal team including outside firms and advisors and must be able to navigate health care law, and strategic guidance and consultation to leadership and operations on a comprehensive range of legal and risk management related issues.
The individual selected for this position will be a highly strategic, proactive attorney who is well versed in the business dynamics and regulatory environment of the healthcare industry. They are innovative and entrepreneurial, and someone who creates solutions that facilitate our ability to serve our members across the country.
Key Responsibilities:
Legal Advisory: Provide expert legal advice regarding employee benefits laws, including ERISA, HIPAA, ACA, and COBRA, to inform decision-making within the company.
Compliance Management: Interpret and monitor changes in laws and regulations impacting self-funded health plans and advise the organization on regulatory compliance strategies.
Policy Development: Counsel on the development of internal policies aimed at minimizing legal risks associated with employee benefits and related compliance matters.
Training and Education: Prepare and facilitate training sessions for employees on relevant legal topics, ensuring understanding of compliance issues and legal best practices.
Document Drafting: Draft, review, and revise Consumer Driven Health Plan documents, SPDs, and other employee communication materials, ensuring clarity and compliance.
Risk Assessment: Evaluate and communicate potential legal risks in various employee benefit matters and recommend appropriate actions.
Litigation Management: Oversee employee benefit-related litigation managed by outside counsel, ensuring strategic handling of cases.
Collaboration: Work closely with outside counsel to obtain specialized legal expertise when required.
Ad-hoc Legal Support: Perform other duties as assigned by the President or CEO.
Requirements
Qualifications:
- Juris Doctor (JD) degree from an ABA accredited law school.
- Licensed to practice law in any state (preferably Texas).
- Minimum of 5 years of relevant experience in insurance, employee benefits, or third-party administration.
- Comprehensive knowledge of ERISA, HIPAA, the Affordable Care Act, COBRA, and Internal Revenue Code related to self-funded health plans.
- Strong expertise in state and federal laws affecting TPAs, insurance, privacy, and employment law.
- Proven experience with DOL and IRS audits.
- Proficiency in Microsoft Word, Outlook, and Excel.
- Exceptional communication, negotiation, and interpersonal skills.
